MINUTES
EASTHAM BOARD OF HEALTH
THURSDAY, April 30, 2009
3:p.m.

Dr. Stan Holt opened the meeting at 3:p.m.

OPENING STATEMENTS:

Jane Crowley gave her monthly update.


In March and April 2009 there have been many more cases of swine flu than usual in Mexico and the U.S.  For more information about seasonal swine flu contact the MA. Department of Public Health, Division of Epidemiolgy and Immunization at 617-983-6800.



Jane took part in an interview on National Public Radio concerning waste water
        on the lower Cape.

Rabies Baiting program took place in Eastham April 29

VNA held a Nutrition  program April 16, 2009 at the Eastham Methodist Church.


Conference  calls concerning emergency procedures for the Cape have been very informative.



VARIANCE



Derek Reicherter                345 Harmes Way          Map-1   Parcel-110

David Lajoie (Felco Engineering) submitted plans to upgrade the septic system. The plan includes secondary treatment with a Waterloo Biofilter system with pressure  dosing. The variances requested are as follows:



40'+- from leach area to wetland  ( Top of Coastal Bank) - Eastham BOH Regulations

20'+- from leach area to wetland ( Salt Marsh)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

1.      Routine water quality test results be provided of exiting well location to assure potability
2.      No increase in design flow be allowed
3.      Secondary treatment with Waterloo Biofilter model UG-550 and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen BOD, TSS, Nitrate (or 2 times per year for seasonal use).  Nitrate-nitrogen not to exceed 19mg/1.  After 2 years period of time reduction of testing could be requested by owner.
4.      Operation and maintenance agreement to be submitted to EBOH. Operation and
maintenance agreement required for life of the system. Operator to report results viaCarmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.


Deed restriction for 3 bedroom use and use Waterloo Biofilter System alternative technology requirement to be recorded on deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
Subject to Conservation Commission approval.
Any increase in habitable square footage would require abutter notification and Board of Health review.

Septic tank and leach field to be abandoned.
Dr. Taylor made the motion to approve the plan with the 9 conditions.
Beverly Knox seconded the motion.

REVIEW



Peter & Joyce Weinman           40 Rogers Lane       Map-21   Parcel-110

        Judy Bersin (Ryder/Wilcox Engineering) Rich Bryant (Cape Associates)
submitted the new building project which replaces the existing 7 bedroom with a new 3 bedroom dwelling.  The property has a 770 gallon tight tank with Title 5 variances previously approved by EBOH as listed per plan submitted by Ryder/Wilcox dated 3/27/2000.   The Board approved this building project which reduces the septic flow.  The conditions for approval are:



Routine water quality test results be provided of existing well location to assure potability.
No increase in design flow be allowed.
Deed restriction for 3 bedroom use and requirement of existence of tight tank to be recorded.
Continue to submit pumping information as per earlier conditions per approval 3/27/2000
Subject to Conservation Commission Approval
Tight tank inspection by licensed engineer or inspector to assure the tank is functioning properly.
Dr. Taylor made the motion to approve the building project with the 6 conditions.
Beverly Knox seconded the motion.

Bill Murphy     30 Rogers Lane          Map-21   Parcel-72

        Mr. Murphy (the builder) submitted proposed renovation plans to the property
 owned by Daniel Sullivan. The plan includes a new stairway to the second floor and build a bedroom into the cathedral ceiling space. The property has an engineering Title 5 septic system for 3 bedrooms.  The renovation will not result in any increase in flow or change in footprint.
Beverly Knox made the motion to approve the proposed renovation.
Dr. Taylor seconded the motion.

David Crimmins          17 West Shore Drive     Map-7A   Parcel-11

Mr. Crimmins came before the Board requesting a building permit for an addition to add a three seasons porch to his existing dwelling.  No engineering Title 5 plan with design criteria exists.  It appears from a previous inspection report on file that the leach area is approximately 80 ft. from the well.  The approval is granted with the following condition:



Inspection of the septic system by a licensed engineer or septic inspector to assure the system is functioning properly.

Pat Lariviere made the motion to approved the request for the addition with the 1 condition.
Beverly Knox seconded the motion.

John & Patricia Skrip Jr.               625 Massasoit Road      Map-8   Parcel-250

Mr. Pike (builder) representing the property owners submitted a request for a building permit to finish a room above the existing garage to be used as an office.
The Board required additional information before making a decision on this request.  The Board made the suggestion that the owner could sign a deed restriction for 3 bedrooms or install an alternative system for 4 bedrooms.
Dr. Holt made the motion to deny the request until more information about the project is submitted.
Beverly Knox seconded the motion.
SO VOTED UNANIMOUSLY
